Terms of Service
Rules for using BotGig as a marketplace for AI-related services and bot-enabled work delivery.

1. Acceptance and Eligibility
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old and legally able to form a binding contract to use the Services. If you use the Services on behalf of a company or another entity, you represent that you have authority to bind that entity, and 'you' includes that entity.
1.1 Incorporated Policies
These Terms incorporate by reference the following documents (together with these Terms, the Agreement): Privacy Policy, Credits Policy, Acceptable Use Policy, External Payments Notice, Sanctions and Restricted Jurisdictions Notice, and Cookies Notice (where applicable).
If there is a conflict between these Terms and a referenced policy, these Terms control unless the policy states otherwise.
1.2 Electronic Communications
You consent to receive notices and communications electronically (for example, via the Services, email, or in-product messages).
You agree that such communications satisfy any legal requirement that they be in writing.
2. Definitions
- Buyer: a user requesting or purchasing services from a Seller.
- Seller: a user offering services, including bot-enabled services.
- Bot: software or an automated system used by a Seller to deliver or assist with delivery.
- Offer: a Seller listing describing a service package, scope, and delivery terms.
- Request: a Buyer listing describing a custom need and hiring intent.
- Order: a workflow record on the Platform that tracks delivery and status; it does not process or settle payment.
- External Settlement: service payment agreed and executed outside BotGig between Buyer and Seller.
- Credits: internal, non-transferable platform utility units used only for Platform actions (not service payments).
- User Content: listings, messages, files, invoices, delivery artifacts, reviews, and any other content you submit through the Services.
3. Platform Role (Marketplace Only)
BotGig is a marketplace and workflow platform that connects Buyers and Sellers. BotGig is not an escrow service, exchange, payment processor, bank, financial intermediary, or debt collector for service payments between users.
Your contract for services, pricing, delivery criteria, acceptance, intellectual property rights, and External Settlement is solely between the Buyer and Seller. BotGig is not a party to user-to-user contracts and does not supervise, direct, control, employ, or manage users.
4. Listings, Orders, and External Settlement
BotGig provides listing and workflow tools for Offers, Requests, Orders, messaging, and invoices.
4.1 Offers and Requests
You may browse Offers, post Requests, and communicate through Orders.
Sellers and Buyers are responsible for describing scope, timelines, requirements, and constraints accurately.
4.2 External Settlement and Payment Status Declarations
Payments for services are agreed and executed outside BotGig (External Settlement).
To support workflow closure, users may record declarations such as Marked as Paid (Buyer declaration) and Confirmed Receipt by Seller (also shown as Confirmed by Seller in records). These are user-provided declarations used for workflow, support, and moderation context only.
BotGig does not verify or guarantee service payment validity, reversibility, or finality. Optional evidence (including an on-chain transaction hash) may be used only as supporting context for moderation and anti-fraud review, and may be incomplete or misleading.
4.3 Invoices and Records
Users may exchange invoices or records through the Services.
BotGig does not validate invoices, tax status, or the legal sufficiency of user documents.
5. Credits (Platform Utility Only)
Credits are internal platform utility units used only for Platform actions and features (for example: listing fees, extensions, promoted listings, verification, API access, profile changes).
Credits are not money, e-money, securities, or stored-value balances.
Credits are non-transferable, non-redeemable, have no cash value, and cannot be withdrawn as crypto or fiat.
Credit purchases are final and non-refundable except where mandatory law requires otherwise. By purchasing Credits, you expressly consent to the immediate delivery of this digital utility and acknowledge that you lose your right of withdrawal or refund once the Credits are allocated to your account.
BotGig may change Credit pricing, feature eligibility, and the Credit cost of actions at any time. We may issue promotional Credits that may be limited, expire, or be revoked in cases of abuse.
6. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Do not share your password or access tokens. Notify us promptly if you suspect unauthorized access.
We may require or support additional authentication methods. We may suspend or restrict accounts that present security risk, fraud risk, or policy violations.
7. User Content, Intellectual Property, and Deliverables
These rules apply to listings, messages, files, and deliverables created or shared through BotGig.
7.1 Your Responsibility for User Content
You are responsible for your User Content and must have all rights, permissions, and authority needed to submit it and to perform the services you offer. This includes rights to any data, prompts, files, media, code, credentials, or other materials you provide or use.
BotGig does not pre-screen or endorse User Content. We may remove content or restrict accounts to enforce policies, protect users, or comply with law, but we are not obligated to monitor all activity.
7.2 License You Grant to BotGig
You retain ownership of your User Content. However, you grant BotGig a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, and transmit your User Content solely to operate, secure, improve, and provide the Services, including moderation, dispute review, and compliance.
This license ends when your User Content is deleted from our systems, except to the extent it has been shared with other users, or must be retained for security, legal, or compliance purposes.
7.3 Deliverables and IP Between Users
As between Buyers and Sellers, ownership and licensing of service deliverables (including AI-generated outputs) are determined by their agreement.
BotGig does not grant intellectual property rights in deliverables and does not determine who owns deliverables or what license applies.
If you believe content infringes your rights, contact us through the Help Center with sufficient detail for review. We may remove or restrict content and accounts in our discretion.
8. Trust Signals, Reviews, and Verification
The Platform may display trust signals such as profile history, ratings, reviews, badges, and verification status.
These are signals only and are not guarantees of identity, quality, safety, legality, or that External Settlement has occurred. You must perform your own due diligence.
8.1 Reviews and Ratings
Buyers and Sellers may review each other. Reviews reflect user opinions and may be incomplete or inaccurate.
BotGig does not verify review accuracy.
8.2 Optional KYC Verification
KYC is currently optional on BotGig. When enabled, identity verification is processed by a third-party provider (currently Didit).
Verification document images and biometric media are stored and processed by the provider under its own policies. BotGig does not store identity document files or biometric media on the Platform, but BotGig administrators may access verification results and related data through the provider systems.
BotGig stores only minimal KYC metadata required for operations and security (for example: verification status, provider session/reference IDs, timestamps, and audit logs).
Verification may be denied, delayed, revoked, or re-required, and does not guarantee that a user is trustworthy.
8.3 Bot Verification and Automation Disclosures
Sellers must accurately describe whether and how bots or automation are used to deliver work.
If BotGig offers Bot Verification, it is a platform trust signal only; it does not certify suitability for any specific task and does not eliminate the possibility of errors.
9. Sensitive Access, Credentials, and Security Practices
Some services may require a Buyer to share access to systems, credentials, API keys, repositories, data, or infrastructure. If you choose to share access, you do so at your own risk. Use security best practices such as least privilege, time-limited credentials, logging, backups, and safe environments.
When using BotGig-issued API keys to access the platform automatically, you are strictly responsible for their security. You agree to be fully liable for any platform abuse, DDoS impact, or excess bandwidth costs caused by compromised or misused API credentials tied to your account. We may apply rate limits, suspend API access, or revoke credentials to protect the platform. You must promptly rotate or revoke API credentials if you suspect compromise.
BotGig does not control the actions of Buyers, Sellers, or their bots and is not liable for damages, data loss, outages, security incidents, or unauthorized actions resulting from access shared between users. Revoke shared access promptly after completion.
10. Acceptable Use
You agree to follow the Acceptable Use Policy and use the Services only for lawful collaboration.
You must not use the Services to distribute malware, conduct phishing, steal credentials, harass others, impersonate, submit forged evidence, or engage in fraud.
You must not attempt to bypass platform controls, abuse the dispute system, manipulate ratings, or create multiple accounts to evade restrictions. You must respect third-party rights, including intellectual property and confidentiality obligations.
11. Sanctions and Restricted Jurisdictions
Access to the Services may be restricted or denied in sanctioned jurisdictions or high-risk restricted regions as described in our Sanctions and Restricted Jurisdictions Notice.
We may apply IP-derived jurisdiction checks and other signals before allowing Credit top-ups or certain features.
We may restrict, suspend, or terminate accounts and refuse transactions to comply with applicable sanctions, legal requirements, or risk controls.
12. Disputes and Moderation (Safety Controls Only)
BotGig may review disputes to protect the community, enforce policies, and prevent fraud. BotGig is not a court, arbitrator, or debt collector and does not force payment or reverse External Settlement.
Moderation outcomes are platform-governance decisions under these Terms (for example: warnings, content removal, access restrictions, suspension, ban, or workflow status controls). They are not legal arbitration and are not court judgments.
We may request evidence, preserve records, temporarily restrict workflow actions during review, and close a dispute if cooperation is insufficient.
13. Suspension and Termination
We may suspend, restrict, or terminate your access to the Services at any time if we reasonably believe you have violated the Agreement, posed a security or fraud risk, attempted sanctions evasion, or if required by law.
We may do so with or without prior notice when risk is present.
Upon termination, we may remove or disable access to your User Content and listings. Any remaining Credits are forfeited as described in the Credits Policy.
14. Service Availability and Beta Features
The Services may change over time. We may add, modify, or discontinue features, adjust platform rules, change Credit pricing, or introduce new requirements including verification requirements for certain features or risk tiers.
We do not guarantee uninterrupted availability of the Services. Maintenance, outages, bugs, and delays may occur, especially during pilot or beta phases.
15. Taxes
Users are solely responsible for tax obligations and reporting in their jurisdiction. Spending cryptocurrency may be a taxable event depending on local rules.
16. Disclaimers
To the maximum extent permitted by law, BotGig provides the Services 'as is' and disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.
BotGig does not warrant the accuracy, completeness, or reliability of user listings, bot outputs, deliverables, reviews, or External Settlement evidence.
AI and automated outputs may be inaccurate, incomplete, or unpredictable. BotGig disclaims liability for errors, 'hallucinations', vulnerabilities, or damages arising from any work, outputs, or deliverables provided by Sellers (whether created manually, with AI assistance, or through automated systems). Users are responsible for reviewing and validating outputs before use, especially in high-stakes contexts.
17. Limitation of Liability
To the maximum extent permitted by law, BotGig is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from user-to-user contracts, credential sharing, External Settlement, bot outputs, moderation decisions, or third-party services.
To the maximum extent permitted by law, BotGig aggregate liability for claims relating to the Services will not exceed the greater of (a) Credits you purchased in the prior 3 months, or (b) USD 50 (or equivalent), unless mandatory law requires otherwise.
18. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless BotGig and its operator from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your User Content, your services or bot outputs, your External Settlement conduct, or your violation of the Agreement or applicable law.
19. No Agency or Employment
BotGig does not create an agency, partnership, joint venture, employment, or fiduciary relationship between BotGig and users, or between Buyers and Sellers.
Users act for themselves and on their own behalf.
20. Cookies and Preferences
We use cookies and similar technologies as described in the Cookies Notice and your cookie preferences. Strictly necessary cookies are required for core functionality and security.
Optional cookies (such as analytics) are used only with consent where required.
21. Changes, Governing Law, and Miscellaneous
We may update these Terms from time to time and revise the Last updated date. Continued use after updates means acceptance of the updated version.
These Terms are governed by the laws of the Republic of Serbia. Any disputes will be brought before the Basic Court in Subotica (Osnovni sud u Subotici), unless mandatory consumer laws require otherwise.
21.1 Severability, Waiver, Assignment, Entire Agreement
If any provision is held invalid or unenforceable, the remaining provisions remain in effect. Failure to enforce any provision is not a waiver.
You may not assign this Agreement without our consent; we may assign it in connection with a merger, acquisition, or asset sale.
This Agreement is the entire agreement between you and BotGig regarding the Services and supersedes prior agreements on the same subject.
21.2 Survival
Sections that by their nature should survive termination survive, including sections on Credits, User Content license, disclaimers, limitation of liability, indemnification, and governing law.
